The decision to go into a rehabilitation program for drug addiction and alcohol treatment can be daunting. It is particularly challenging if you are supporting children, a spouse or other family members.

Although the specific options that are available to help you support your loved ones while you are in a treatment program can depend on your specific situation, you do have rights that can help with the decision-making process.

Legal Rights for Drug and Alcohol Addiction

The Substance Abuse and Mental Health Services Administration explains that there are federal laws that protect you and your loved ones when you enter a treatment program. An individual who has a substance use disorder is protected by disabilities acts and laws to help prevent discrimination when a treatment program is completed.

Although a substance use disorder can be classified as a disability, the Substance Abuse and Mental Health Services Administration explains that individuals who are currently abusing an illicit substance or those who pose a threat to others may not qualify for the rights and protections that are related to disabilities.

The Family and Medical Leave Act

The Family and Medical Leave Act can be an important part of protecting your current place of employment. According to the U.S. Department of Labor, eligible employees are allowed to take up to 12 weeks of unpaid leave from an employer for medical reasons within a 12 month period, which can include the decision to enter a treatment program.

Due to the FMLA, you or a loved one can enter drug and alcohol treatment without the risk of losing a position in a current career.

Psych Central explains that you are not required to provide the details or reasons behind the medical leave as long as you have been diagnosed by an appropriate medical professional.

As a result, you can enter a drug rehabilitation program for up to three months to start working toward your recovery goals. When the treatment program is completed, you will still have a job and you can continue supporting your loved ones.

Finding Work After Drug Rehabilitation

If you decide to seek employment in a different company or if you have lost a job before entering a drug and alcohol treatment program, then you will need to recognize your rights and options before you finish the treatment program.
